ARTICLE 1: SCOPE
The present general conditions of sale govern the sale of products presented on the site www.uomo-jewelry.fr (hereafter the "Site"). Any order implies the full acceptance of these general conditions of sale which aim to define the rights and obligations of the parties within the framework of the online sale of goods and services offered by Uomo. The products offered by Uomo are reserved for adults or minors holding parental authorisation to place an order on the site.
ARTICLE 2 : OFFER
Our offers of products, services and terms of delivery are indicated in Euros and are valid while stocks last.
ARTICLE 3 : PRICES
3.1 - All the prices of our products are indicated in Euros and take into account the French VAT in force. Any change in the VAT rate could be immediately reflected in the prices. These prices do not include shipping costs.
3.2 - In the event of an order to a country other than metropolitan France, you are the importer of the products concerned. For all products shipped outside the European Union and DOM-TOM, the price will be calculated excluding taxes automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and taxes are not the responsibility of Uomo. They are at your charge and are your responsibility for declarations and payments to the competent authorities and organizations in your country. We recommend you to inquire about these aspects with the local authorities of your country.
3.3 - Uomo reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates in force at the time of the recording of the orders, as indicated on the Site.
3.4 - The products remain the property of Uomo until full payment is received by Uomo.
3.5 - The products and services sold on the Site are reserved for private individuals.
The payment of the on-line purchases is carried out by bank card via the platform of protected payment PayPal.Uomo reserves the right to suspend any management of order and any delivery in the event of refusal of authorization of payment by bank card or in the event of non-payment. Uomo also reserves the right to refuse to honor an order emanating from a customer who would not have regulated the entirety of a preceding order. Except contrary proof, the data recorded by Uomo constitute the proof of the whole of the transactions passed between Uomo and the customer.
5.1 - Generalities
The times indicated on the Site are usual average times and correspond to the processing and shipping times. The products are delivered by La Poste or another carrier to the delivery address indicated by the customer when ordering. When the customer orders several products at the same time and these have different shipping times, the shipping time of the order is based on the longest time. Uomo reserves the possibility of splitting the shipments. The contribution to the processing and shipping costs will only be charged for one shipment. Uomo cannot be held responsible for the consequences due to a delay in delivery. Any order not shipped within 30 days of the order will be cancelled unless otherwise stipulated and announced in the offer of sale.
5.2 - Delivery times
The delivery times of the products vary according to the availability of the products. The delivery of products varies between 5 days and 3 weeks. Uomo undertakes to inform the customer as soon as possible if the deadline is not met. Exceeding these deadlines shall not give rise to any cancellation of the order, reduction of the price paid by the customer, or payment of damages, as long as the customer is delivered within 30 working days following the confirmation of his order. In the event that the goods are unavailable within the 30-day period, after informing the customer, Uomo will reimburse the customer.
The customer has a period of seven clear days to exercise his right of retraction without having to justify his reasons or pay any penalties, except for the cost of returning the product, as long as it is returned to Uomo in its original condition and in its original packaging. In this case, Uomo will proceed to the reimbursement of the product upon receipt by Uomo of the product, complete, in its original state and its original packaging. However, in accordance with the provisions of article L. 121-20-2 of the French Consumer Code, goods and objects made to the customer's specifications or personalised at the customer's request cannot benefit from the right of withdrawal and will not be returned or exchanged, except in the case of the implementation of the guarantee of defects affecting the object sold.
Withdrawal period
In accordance with the provisions of article L221-18 of the Consumer Code, the Customer has a period of fourteen (14) days from receipt of his order to exercise his right of withdrawal and make a request for return or exchange, without having to justify reasons or pay a penalty.
Condition of products
Returned items must be:

Unworn, unused;

In perfect condition;

In their original packaging, with all the labels and accessories provided upon delivery.
Any return not respecting these conditions may be refused by Maison Di Giorgio.
Return procedure
To exercise his right of withdrawal and make a return, the Customer must follow the following procedure:

Logging into the customer account
The Customer logs into their personal space via the access icon provided for this purpose, enters their email address, and enters the six-digit verification code received by email. -
Return Request
In the "My Account" area, the Customer selects the order in question, indicates the items to be returned, specifies the reason for the return and can add an additional note. The request is then subject to validation. -
Analysis and validation
After receipt and analysis of the request, Maison Di Giorgio informs the Customer by e-mail of the acceptance or refusal of the return. -
Return Shipping
If approved, the Customer will receive the necessary instructions and a prepaid return label. The package must be dropped off at a post office as soon as possible.
Exchanges
• Size Exchange
Size exchanges are free.
Once we receive your return, we will ship you the new size within 24 hours.
• Exchange for another item
You can exchange an item for another style or color by issuing a voucher for the original amount.
This voucher is valid for 6 months and can be used throughout the site.
Refund
You can request a refund for any reason within 14 days of receiving your order.
A flat-rate deduction of €10 will be automatically deducted from your refund, corresponding to logistics and processing costs.
After receiving your return, you will be refunded within 7 to 15 days, depending on your payment method.
In the event of a dispute, an amicable solution will be sought before any legal action is taken, it being recalled that this search for an amicable solution does not preclude the legal guarantees of conformity of the goods to the contract and hidden defects from which the customer benefits. In the absence of agreement between the parties, any legal action will be brought before the Commercial Court of Paris.
ARTICLE 9 : DURATION
The offers are valid while stocks last and without prior warning of the end of an offer.
ARTICLE 10: ACCEPTANCE AND CANCELLATION
All orders are considered firm and can only be cancelled with the express consent of Uomo and under conditions that will compensate it for any prejudice or damage caused by this cancellation.
ARTICLE 11 : INTELLECTUAL PROPERTY
All the jewels presented on the site or visual or sound elements of the Site are protected by copyright, drawings or trademarks. They are the exclusive property of Uomo. Any deterioration, as well as, in the absence of authorization, any representation, reproduction, modification, commercial use, total or partial, of the various elements of the Site is prohibited and exposes its author(s) to prosecution. Any user who wishes to create an electronic link to the Site must request prior authorisation from Uomo.
ARTICLE 12 : RESPONSIBILITY FOR DATA
Uomo makes every effort to ensure the confidentiality and security of data that may be entered or transmitted on the Site. Uomo does not keep the data relating to our customers' credit cards following payment. In accordance with the law "Informatique et Libertés" of January 6, 1978, you have a right of access and rectification of the data concerning you. You just have to send us by mail the opposition of access to your personal data by proving your identity.
ARTICLE 13: FORCE MAJEURE
Neither party will have failed in its contractual obligations, insofar as their execution will be delayed, hindered or prevented by a fortuitous event or a force majeure. Will be considered as fortuitous event or force majeure all facts or circumstances irresistible, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which could not be prevented by the latter, despite all efforts reasonably possible. The party affected by such circumstances shall notify the other within ten working days of the date on which it becomes aware of them. The two parties will then meet, within a period of one month, unless this is impossible due to force majeure, to examine the impact of the event and to agree on the conditions under which the execution of the contract will be continued or, if necessary, the order cancelled.
ARTICLE 14 : WARRANTY AND AFTER-SALES SERVICE CONDITIONS
All manufacturing, whatever the care, attention or quality of the materials used, involves, despite rigorous control, risks of manufacturing imperfections which require appropriate treatment. To this end, and to meet the needs of its customers, Uomo has drawn up the following charter, enabling everyone to appreciate the extent and limits of the guarantees provided.
A) GUARANTEES:
The jewels Uomo benefit from a double guarantee.
a) Guarantee against hidden defects
This guarantee is exercised under the conditions expressly defined by the law and within the period of recourse fixed.
In the event of a hidden defect affecting a piece of jewellery of the Uomo Brand, the Company undertakes to replace the article within 4 weeks of the return by the private individual, provided, however, that it is a piece of jewellery still appearing in the Brand's catalogue
Otherwise, a replacement item equivalent in value will be offered.
b) contractual guarantees.
Uomojewellery is also guaranteed by the company under the conditions specified below, for a period of six months from the day of the sale, transaction made on the site.
The guarantee covers possible modifications, alterations, degradations of the jewels inherent to the manufacture or to the nature of the employed material.
Are excluded from the guarantee:
- The degraded articles, damaged by an abusive use or by a use not in conformity with the nature, the coating, the material used by the manufacturer. Contact with detergents, sea or swimming pool water, lacquer, perfumes, acid products or any other liquids likely to alter the coatings, materials or simply modify the appearance are prohibited.
- The Company reserves the right to assess, at its discretion, whether the conditions of the contractual guarantee are met, upon receipt of the defective item.
1) Exercising the guarantee:
Before sending the item, the private individual must:
- provide proof of purchase, with the date and reference. (invoice or copy of the transaction made on the site .....)
- send the article in an envelope specially adapted to avoid any damage, to the Company's head office.
2) methods of intervention within the framework of the above guarantees:
- hidden defect: The Company will proceed to the pure and simple replacement of the defective article within a period of fifteen days, subject to availability in stock.
Otherwise, a delay of three to four weeks will be necessary
- contractual guarantee: when the Company, upon receipt of the jewel and proof of purchase, dated and referenced, has estimated that the guarantee applies, it will proceed as follows:
Repair of the article, if technically possible within 3/4 weeks
Identical replacement, subject to availability in stock, within 3/4 weeks.
The articles sent by the private individual are done at the expenses of this last one which also assumes the risk of loss or damage.
The reforwarding of the jewels of which the Company will have accepted the setting in play of one of the two guarantees this above, will be ensured by the supplier and with its expenses.
B) SERVICE AFTER SALE
The Company ensures the service after sale under the restrictive conditions below specified.
This intervention is part of an ongoing and lasting commercial relationship between the customer and the supplier intended, in the mutual interest, to facilitate the maintenance of commercial links.
Repairs are invoiced according to the extent of the damage suffered by the jewel.
A minimum fixed price of 25 € will be applied, including the postal costs of re-shipment. The sending of the article for repair implies the acceptance, without any other formality, and the commitment to pay the above-mentioned fixed price.
If the cost exceeds the fixed price, the Company will inform the customer, by e-mail, of the amount to be paid and, after confirmation, the jewel will be repaired.
This repair will be carried out within a period of 3/4 weeks.
When the jewel is technically or economically irreparable, it will be scrapped or returned to the professional against payment of postal charges.
APPENDIX: APPLICABLE TEXTS
Article L. 211-4 of the Consumer Code
The seller is required to deliver goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery. He is also responsible for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility.
Article L. 211-5 of the French Consumer Code
To be in conformity with the contract, the goods must: 1° - Be fit for the use usually expected of similar goods and, where applicable : - correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model; - have the qualities that a buyer may legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labelling; 2° - Or have the characteristics defined by mutual agreement between the parties or be fit for any special purpose sought by the buyer, brought to the seller's attention and accepted by the latter
